Finder Rewards “Refer a friend” Reward Promotion – Terms & Conditions

About this Promotion

This 'Refer a Friend' Promotion is a loyalty scheme reward program operated by Finder as part of the broader Finder Rewards program. The Promotion rewards Eligible Members for introducing new members to the Finder platform. The Referral Reward is not a financial product and is not the subject of any personal financial product advice.

The Eligible Member is not engaged by Finder to promote, distribute, arrange, sell, advise on or make recommendations about any Eligible Product. The Eligible Member is not an agent, representative, sub-representative, employee or contractor of Finder or any Finder-partner in connection with this Promotion.

Overview

• Hive Empire Pty Ltd (trading as finder.com.au) ("Finder") is offering Rewards to Finder Members who purchase an Eligible Product through the Finder Comparison Service ("Finder Site"). The terms and conditions and eligibility criteria for each Reward is contained in the relevant Eligible Product terms and conditions on the Finder Site ("Reward T&Cs")
• Finder is offering a Refer a Friend Reward ("RAF Reward") to Finder Members (each an "Eligible Member") who refer friends or family to purchase an Eligible Product. These terms and conditions cover the RAF Reward Promotion. An Eligible Member does not need to have purchased an Eligible Product or received a Reward themselves to qualify for a RAF Reward.
• An Eligible Member can receive a RAF Reward for each successful referral (each a "Referred Member") who:
  • either signs up as a Finder Member or is already a Finder Member;
  • Clicks on an Eligible Product using the unique Referral Link provided to the Eligible Member by Finder; and
  • The RAF Reward will only be issued to the Eligible Member after the Referred Member has successfully opted into the relevant Reward and met all eligibility criteria outlined in the Reward T&Cs for the Eligible Product.

By taking part in this promotion, the Eligible Member and the Referred Member agree to these Terms and Conditions. These terms and conditions are to be read in conjunction with the Reward T&Cs for the Eligible Product and privacy policy.

The RAF Reward promotion will run for the promotion period advertised on the Finder Site and may be amended by Finder at any time.

These offers are available while Reward limits last, whichever occurs first. Finder reserves the right to amend or withdraw these offers at any time.

How to share your Referral Link

When sharing the Referral Link, the Eligible Member must not:

1. describe, promote, endorse, compare or make any representation about the features, terms, benefits, quality, suitability, performance or price of any Eligible Product;
2. provide any advice or make any recommendation about any Eligible Product, including any statement as to whether an Eligible Product is suitable for the Referred Member or any other person;
3. hold themselves out as authorised by Finder or any Finder-partner to sell, arrange or advise on any Eligible Product; or
4. make any statement about any Eligible Product that is misleading, false or deceptive.

The Eligible Member should direct the Referred Member to the Finder-provided product page and the applicable Product Disclosure Statement, Target Market Determination, Financial Services Guide and other disclosures for full information about the Eligible Product.

Sharing Restrictions

The Eligible Member must share the Referral Link only via personal communication channels (such as one-to-one email, SMS, WhatsApp, iMessage, or direct message on a private social media account) and only with individuals with whom the Eligible Member has a genuine personal relationship.

The Eligible Member must not:

1. post the Referral Link on any public forum, deal site or bargain site (including OzBargain, ChoiceCheapies, Reddit, deal-focused Facebook groups, or any similar platform);
2. share the Referral Link in any public post, article, blog, review, video, podcast or advertisement;
3. share the Referral Link on any public social media account, public group, public page or public channel;
4. bid on any keyword containing 'Finder', 'finder.com.au', the name of any Eligible Product or any Finder-partner, or any similar term, for the purpose of driving traffic to the Referral Link;
5. purchase or place any paid advertisement (including search-engine ads, social media ads, display ads or influencer content) that promotes the Referral Link;
6. send any paid traffic, referral network traffic, incentivised traffic or bot-generated traffic to the Referral Link;
7. use any 'black hat' SEO technique, cloaking, doorway page, link farm or similar practice to promote the Referral Link;
8. distribute the Referral Link via any bulk, automated or programmatic distribution channel (including bulk email, mass SMS, automated messaging bots or web scraping tools); or
9. offer, receive or accept any monetary or in-kind consideration from a Referred Member in exchange for the referral, or share the Referral Reward (in whole or in part) with any Referred Member.

Finder may, in its reasonable discretion, disqualify any referral generated in breach of this clause and clawback any Referral Reward already paid in respect of any such referral.

General Referral Rates

The general referral rates are set out in the table below:

Finder may update or amend the above table of Eligible Products and Referral Rewards from time to time.

The Referral Reward will only be issued to the Eligible Member after the Referred Member has successfully opted into the relevant Reward and met all eligibility criteria outlined in the Reward T&Cs for the Eligible Product. All referrals will be assessed on the same eligibility check date as the Referred Member's Reward under the Reward T&Cs, and the Eligible Member will qualify for the Referral Reward provided the Referred Member meets the criteria on this date.

Referral Rewards will be issued electronically as a digital eGift Card in line with the fulfilment timing of the Reward under the Reward T&Cs for the relevant Eligible Product. Finder reserves the right to withhold or revoke the Referral Reward if the Referred Member fails to meet the Reward eligibility.

Referral Rewards will be distributed via email by Blackhawk. See further details below.

Only one Finder Member account can be opened by either the Eligible Member or Referred Member. The Eligible Member cannot refer themselves as a Referred Member, for example by using a different email address, phone number, payment method, device or IP address, and the Eligible Member cannot open a second Finder account for the purpose of self-referral.

Finder may, in its reasonable discretion, disqualify any Eligible Member and revoke or clawback any Referral Reward already paid if Finder becomes aware, or has reasonable grounds to suspect, that the Eligible Member has:

1. breached these Terms and Conditions (including the sharing restrictions and content restrictions);
2. referred themselves, opened multiple Finder accounts, or otherwise sought to manipulate the Promotion;
3. engaged in any fraudulent, misleading or deceptive conduct in connection with the Promotion;
4. engaged in any conduct designed to undermine the intended operation of the Promotion;
5. shared the Referral Link with any person under the age of 18; or
6. provided advice, recommendations or representations about an Eligible Product in breach of the content restrictions.

If Finder revokes a Referral Reward under this clause, the Eligible Member must refund any Referral Reward already provided (including by way of the value of any redeemed eGift Card) within 14 days of Finder's written notice. Finder may validate the eligibility of any Referral in its sole discretion, including by requiring the Eligible Member or Referred Member to provide identity verification or evidence of the personal relationship between the parties.

Both the Eligible Member and the Referred Member must be at least 18 years of age and residents of Australia at the time of the referral. The Eligible Member must not share the Referral Link with any person under the age of 18 or any person the Eligible Member reasonably believes to be under the age of 18.

This Agreement shall be governed by and construed in accordance with the laws of New South Wales and the parties submit to the exclusive jurisdiction of the Courts of New South Wales.

This promotion may not be combined with other offers unless explicitly stated.

The Activ™ Gift Card ('Card') is issued by Heritage and People's Choice Limited trading as Heritage Bank ABN 11 087 651 125 ('Heritage') pursuant to a licence from Visa Worldwide PTE Ltd. All eligible customers will be sent an email containing a code which can be redeemed for a digital Visa card. The code is valid for 90 days from the time of issuance or the stated expiry date. Please note, the code cannot be re-issued or redeemed post the expiry date. The Card is not transferable or redeemable for cash, in part or in whole. The Activ Visa card has a 3-year expiry from the issue date.
