2. Finder App Terms

2.1 Introduction

These Finder App Terms (App Terms) govern your installation, access and use of the Finder App on your device.

The Finder App is designed and owned by Finder Ventures Pty Ltd (Finder Ventures) and operated by Finder. Within the Finder App, you can access and use the Services provided by Finder and the Finder Affiliates.

In these App Terms:

(a) Finder and the Finder Affiliates are referred to as "we", "us" or "our";

(b) you and we may be collectively referred to as "Parties"; and

(c) capitalised words and phrases not otherwise defined have the meaning given in the Terms of Service.

These App Terms form part of, and are incorporated by reference into, the Terms of Service. To the extent of any inconsistency, the Terms of Service prevail.

2.2 Additional Terms and Policies

By using the Finder App, you confirm that you have read and understood the Terms of Service and the Finder Group Privacy Policy. These App Terms are supplemented by the terms of each Service you use through the Finder App:

2.3 Your Data

Based on your interactions with the Finder App and any Services you have opted into (including the Credit Score Service), we may send personalised information to you via the Finder App or by email. How we collect, use, share and store your personal information is set out in the Finder Group Privacy Policy. That policy also sets out how you can access, correct or ask us to stop processing your personal information.

2.4 Acceptable Use

The acceptable use rules for the Online Platform in section 1.11 of the Terms of Service apply to your use of the Finder App. In addition, you must not use the Finder App or any Service available through the Finder App to engage in conduct that, in our reasonable opinion:

(a) is unlawful, defamatory, harassing, threatening or discriminatory;

(b) promotes or encourages physical or mental harm; or

(c) promotes violence, terrorism or unlawful activity.

If you fail to comply with these acceptable use rules, we may (in accordance with section 2.8) refuse to process any transaction and suspend or terminate your access to the Finder App and any Service available through it.

2.5 Biometric Authentication

If your device supports biometric authentication (for example, Touch ID or Face ID on iOS devices, or fingerprint or face unlock on Android devices), you may choose to enable biometric authentication to access the Finder App instead of your PIN or password. For certain transactions we may still prompt you to enter your PIN or password as an additional security measure.

You must not enable biometric authentication for the Finder App if any biometric data stored on the device is not your own. If, after enabling biometric authentication, you allow another person to store their biometric data on your device, you must first disable biometric authentication for the Finder App.

If you allow another person's biometric data to be stored on your device contrary to this section:

(a) that person will be able to access your Finder Account and will be treated as authorised to do so; and

(b) you will be responsible for their transactions.

Biometric authentication technology is provided by your device manufacturer. We are not responsible for any malfunction in that technology, or for changes made to that technology by the manufacturer that affect the way you access the Finder App. You can always access the Finder App using your PIN or password.

2.6 Access PIN and Account Security

Finder App access PIN

When you register for the Finder App, you may set up a Finder App access PIN. You can change this PIN after logging into the Finder App.

Protecting your PIN

You must:

(a) memorise your PIN as soon as possible — if you must record it, disguise it so others cannot decipher it;

(b) choose a PIN that is not obvious or easily guessed (for example, do not use your date of birth or driver's licence number); and

(c) take precautions when entering your PIN (for example, do not let anyone watch you enter it).

You must not:

(a) tell any other person your PIN (including family or friends);

(b) record your PIN on your device or computer; or

(c) keep a record of your PIN with your device.

Other security obligations

You must:

(a) lock your device and take reasonable steps to prevent unauthorised use of the Finder App;

(b) notify us immediately if your device is lost or stolen, or if you suspect that your PIN has become known to another person;

(c) only install approved applications on your device and never jailbreak or root your device; and

(d) not allow another person to use your device to access any Service available through the Finder App, or leave your device unattended.

2.7 Notifications

We may send you notifications via push notification, SMS or other reminder mechanism. Push notifications are sent to any compatible device on which you have installed and registered the Finder App with push notifications enabled and have confirmed your mobile number.

Notifications may be visible on your device lock screen to other people. Please check your device's notification and privacy settings to ensure they are appropriate for your use.

Notifications may include:

(a) security and service alerts;

(b) alerts when new versions or upgrades are available; and

(c) special offers, information and reminders about products and services.

By using the Finder App, you consent to receiving notifications. Delivery of notifications may be affected by connection quality. It is your responsibility to check any notification before acting on it. All notifications are sent and managed in accordance with the Finder Group Privacy Policy. We may suspend or discontinue notifications at any time without notice.

Where a notification constitutes a commercial electronic message (as defined in the Spam Act 2003 (Cth)), it will comply with the Spam Act, including by containing a functional unsubscribe facility.

2.8 Suspension and Termination

The suspension and termination rights in section 1.12 of the Terms of Service apply to your use of the Finder App. In addition, we may suspend or terminate your access to the Finder App, or refuse to process any transaction:

(a) if we reasonably suspect the Finder App is being used in connection with fraudulent or unlawful conduct, or in a way that may cause you or us to lose money;

(b) if we consider it reasonably necessary to comply with any law or regulator direction, or to manage regulatory risk (including managing our compliance with international sanctions, where you are within a sanctioned country); or

(c) at our discretion, in which case we will act fairly and reasonably and take into account your conduct, our conduct and the Services being used.

If we exercise our rights under this section, we will not be liable to you.

2.9 Changes to these App Terms

We may change these App Terms in accordance with section 1.3 of the Terms of Service. We will notify you of any material changes by electronic notice via your device or the App Store, and may require you to confirm your acceptance of the changes to continue using the Finder App.

2.10 Fees

Fees and Charges for the Finder App and any Service available through it are governed by section 1.13 of the Terms of Service. You may also incur charges from your mobile carrier for downloading and using the Finder App.

2.11 Other App-Specific Matters

Email verification

For security reasons, when you register for the Finder App you will be prompted to verify your email address. Once verified, you will not be prompted again on the same device unless you re-register.

Check your details carefully

Please take care to enter correct details when using the Finder App. We do not check that the details you provide are correct, and we may not be able to recover transaction amounts if you enter incorrect details. You cannot delete or cancel a Finder App transaction once it has been made.

Location and device information

If you grant the Finder App permission to use your device's location information, we may log this information for security purposes and to enable Finder App functionality. We may also collect information about your device and network connectivity for security purposes, including device characteristics and unique identifiers, cellular and Wi-Fi network names and encryption levels, and IP addresses. This information is handled in accordance with the Finder Group Privacy Policy.

Apple and Google Play acknowledgment

The Finder App is not provided by Apple, Google or any other device manufacturer or app store operator. Any queries or complaints about the Finder App (including issues about intellectual property) should be directed to us and not to Apple, Google or any other third party. This section applies for the benefit of Apple, Google and any other third-party app store operator through which the Finder App is distributed, who are third party beneficiaries of this section entitled to enforce it against you. You also acknowledge that you are not located in a country subject to any government embargo.
